A Power of Attorney signed and notarized in one of the States, must be apostilled in the same State. For instance, if you signed and notarized your POA in Ohio, only the State of Ohio could process an Apostille on your document.
If your POA is intended for use in a member country of the Hague Apostille Convention, it will receive an Apostille. If your Power of Attorney is needed for use in a Hague Convention non-member country, instead of an Apostille it will receive an Authentication State Certification. Authentication Certificates for use in non-member countries will require the US Department of State certification and Embassy or Consulate legalization.
We recommend that you hire a professional attorney from a country where you need to use your POA to make sure it is prepared correctly. For example, if your Power of Attorney will be used in Spain, we recommend that a Spanish attorney drafts your document. Choosing an experienced attorney from a country of your POA’s destination will eliminate potential errors and rejections. We also recommend preparing a POA in both languages, so for use in Spain, for example, your Power of Attorney will be written in English and Spanish.
If your Power of Attorney is prepared in a foreign language, it may require an English translation. Most states will accept a document in a foreign language as long as this document has been signed and notarized with a proper English notarial affidavit.
Before mailing your documents to our office, please check with us on the requirements for your particular case, as this may prevent you from incurring additional costs and lost time. Some states additionally require County Clerk authentication of the notary’s seal and signature before the Apostille.
